Will contests center on whether an individual possessed the cognitive capacity necessary to execute a valid will. The key legal questions involve whether the individual understood:

  • The nature and purpose of creating a will
  • The extent and nature of their assets
  • The individuals who will be the beneficiaries
  • The consequences of their estate planning decisions

Dr. Stander conducts comprehensive medical record reviews and/or an independant medical examination to determine whether dementia, delirium, stroke, neurological disease, medication effects, psychiatric illness and/or other medical impairments have impacted testamentary capacity at the time the will was executed.

Undue Influence or Financial Exploitation of Vulnerable Adults

Allegations of undue influence involve concerns that an elderly or medically vulnerable individual was improperly influenced by caregivers, family members, friends, financial advisors, fiduciaries and/or new romantic partners. Dr. Stander evaluates the medical, cognitive and social factors that may have increased an idividual's susceptibility to undue influence or financial exploitation.
